These Terms and Conditions ("Terms") govern your access to and use of the TaleIt.ai website and services (the "Service"), operated by TaleIt LLC, a limited liability company located in Pleasant Grove, Utah, United States. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1Eligibility and Age Restrictions

  • You must be at least 13 years old to use the Service. We do not knowingly allow users under 13 to register or provide personal data.
  • If you are under 18, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.
  • TaleIt LLC reserves the right to suspend or terminate accounts created in violation of this policy.
  • The Service is designed for parents, grandparents, educators, and self-publishers, with safeguards to promote safe, family-friendly content.

2Account Registration and Security

  • You must provide accurate account information, including a valid and verifiable email address.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • TaleIt LLC uses industry-standard measures (encrypted databases, hashed passwords, controlled access).
  • You may request account deletion at any time; personally identifiable information will be deleted within 30 days of a verified request, subject to retention for legal or compliance reasons.
  • TaleIt LLC is not liable for unauthorized access caused by your failure to secure your account.

3Description of Services and Third-Party AI Disclaimer

TaleIt.ai is a SaaS platform for generating personalized children's books using artificial intelligence. Features may include:

  • Creating characters via text or images.
  • Maintaining consistency across multiple books.
  • Purchasing credits for book creation, regeneration, and optional drop-shipping of physical copies.

Third-Party AI Disclaimer

  • The Service relies on third-party AI providers for content generation. TaleIt LLC does not control or endorse AI outputs and makes no guarantees as to their accuracy, safety, or compliance with laws.
  • You are solely responsible for reviewing and approving outputs before use, especially before publishing, distributing, or showing them to children.

Usage Rules

  • Acceptable Use: You may not upload or generate content that is illegal, infringing, harmful, misleading, or offensive. You may not upload or attempt to replicate copyrighted characters, brands, or other protected works.
  • Commercial Use: You may use outputs commercially, at your own risk. TaleIt LLC provides no warranty that outputs are free from infringement or suitable for commercial use.
  • Limits: Access is subject to your purchased credits.

TaleIt LLC may use anonymized inputs/outputs internally to improve the Service but will not resell or publicly distribute your personal stories without consent.

4Pricing, Payments, and Refunds

  • Services are accessed via purchased credits. Credits are non-transferable and do not expire.
  • Credit exchange rate: $1 USD = 100 credits.

Service Pricing

  • Character Creation: 150 credits per character. Creates a consistent character with multiple poses and expressions for use across stories.
  • Book Creation: 500 base credits + 15 credits per page. A standard 12-page book costs 680 credits total (500 + 12 × 15).
  • Image Regeneration: 15 credits per regeneration after free allowances are exhausted.

Free Allowances

  • Book Image Regenerations: First 10 regenerations per book are free. Additional regenerations cost 15 credits each.
  • Character Image Regenerations: First 5 regenerations per character are free. Additional regenerations cost 15 credits each.
  • New User Bonus: New accounts receive free tokens to create their first character and 12-page book at no cost.

Payment Terms

  • Pricing and credit values may change with at least 30 days' notice by email or in-app notification.
  • Payments are processed by third-party processors (e.g., Stripe) and include applicable taxes and fees.
  • Credit purchases are non-refundable, except as required by law. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your jurisdiction.
  • TaleIt LLC may, at its discretion, issue credits to resolve service issues but is not obligated to do so.

5Physical Book Orders and Fulfillment

Order Process

  1. Order Placement: You provide shipping information, select book format and quantity, and complete payment through Stripe
  2. Order Processing: We generate print-ready PDF files from your book content
  3. Production: Your order is submitted to our print-on-demand partner for printing
  4. Shipping: The printed book is shipped directly from the print facility to your specified address
  5. Delivery: You receive tracking information and delivery updates via email

Pricing and Fees

  • Book Price: Includes production costs, service fees, and applicable shipping costs
  • Shipping Costs: Calculated based on destination, shipping method, and quantity; displayed at checkout
  • Taxes: Sales tax and VAT are calculated and collected as required by law
  • Currency: All prices are displayed and charged in USD
  • Price Guarantee: The price displayed at checkout is final for that order

Shipping and Delivery

  • Shipping Options: Multiple shipping speeds are available depending on destination (standard mail, priority, express)
  • Delivery Estimates: Estimated delivery dates are provided but not guaranteed; delays may occur due to production, shipping carriers, or customs
  • Shipping Restrictions: We cannot ship to all countries; availability is determined at checkout based on our print partner's capabilities
  • Address Accuracy: You are responsible for providing accurate and complete shipping information; orders shipped to incorrect addresses due to user error may incur additional shipping charges for reshipment
  • International Orders: Import duties, taxes, and customs fees are the responsibility of the recipient and are not included in the order total
  • Undeliverable Orders: Orders returned as undeliverable will be reviewed on a case-by-case basis; refunds or reshipments are at our discretion

Order Cancellation

  • Cancellation Window: Orders may only be cancelled before production begins (typically within a few hours of order placement)
  • Production Status: Once an order enters production with our print partner, it cannot be cancelled
  • Refund Processing: Approved cancellations are refunded to the original payment method within 5-10 business days
  • Full Refund: Orders successfully cancelled before production receive a full refund including shipping costs
  • Cancellation Request: To cancel an order, use the cancel button on your order details page in the Orders tab of your account; cancellation requests must be submitted before production begins

Returns and Defects

  • Defective Products: If you receive a defective book (printing errors, binding issues, damage during shipping), contact us within 30 days for a replacement or refund
  • Quality Standards: We are responsible for print quality issues; we are not responsible for content quality, as you approve all content before ordering
  • Proof of Defect: Photos of defects may be required for replacement or refund processing
  • No Returns for Change of Mind: We do not accept returns for non-defective products or buyer's remorse
  • Replacement Process: Approved replacements will be reprinted and shipped at no additional cost

Order Limitations

  • Content Requirements: Books must be complete and in "ready" status before ordering
  • Format Options: 8.5" × 8.5" square format available in paperback and hardcover
  • Page Requirements: Minimum page counts apply based on format (32 pages for paperback, 24 pages for hardcover)

Third-Party Fulfillment

  • Print Partner: Physical books are printed and shipped by our third-party print-on-demand partner
  • Partner Terms: Orders are also subject to our print partner's terms of service and production policies
  • Service Disruptions: We are not liable for delays or issues caused by our print partner, shipping carriers, customs, or circumstances beyond our control
  • Quality Standards: Print quality is subject to our print partner's production standards and capabilities

6Intellectual Property and Indemnification

  • Your Rights: You retain ownership of outputs you generate and may use them commercially.
  • Your Responsibility: You represent that your inputs (prompts, uploads) do not infringe third-party rights. You are solely responsible for legal clearance of your outputs.
  • Indemnification: You agree to indemnify, defend, and hold TaleIt LLC harmless from any claims, damages, or costs arising from your inputs, outputs, or use of the Service.
  • License to TaleIt LLC: You grant TaleIt LLC a limited, worldwide, royalty-free license to use your inputs and anonymized outputs solely for the purpose of operating, maintaining, and improving the Service. TaleIt does not claim ownership of your generated works.
  • TaleIt Rights: TaleIt LLC retains all rights to the Service, platform, and underlying AI technology.

Printed Book Rights

  • Print Rights: By placing an order for a physical book, you confirm you have the right to print and distribute the content
  • No Infringement: You represent that your book does not infringe any third-party intellectual property rights, including copyrights, trademarks, or rights of publicity
  • Content Responsibility: You are solely responsible for the content of your printed books and any legal issues arising from their distribution
  • Indemnification for Orders: You agree to indemnify TaleIt LLC and our print partners against claims arising from the content of your printed books

7Privacy and Data Protection

  • TaleIt LLC collects and processes account data, prompts, uploads, outputs, and technical data necessary to provide the Service.
  • For physical book orders, we collect shipping addresses, recipient information, and payment details necessary to fulfill your order.
  • Data is retained while your account is active or as required by law. You may request deletion at any time.
  • Data may be shared with essential third parties (payment processors, AI providers, hosting services, print-on-demand partners, shipping carriers).
  • TaleIt LLC complies with COPPA, CCPA, and GDPR where applicable. If we discover personal data from a child under 13 without verified parental consent, we will delete it immediately.
  • In the event of a data breach, affected users will be notified promptly by email.

8Disclaimers

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • TaleIt LLC does not warrant that outputs are accurate, suitable for children, legally compliant, or free from third-party rights.
  • Outputs may contain errors, biases, or inappropriate content. You are responsible for review before use.
  • The Service does not provide professional advice (educational, medical, legal, or psychological).
  • Physical book quality is subject to our print partner's production standards; we make no warranties regarding print quality beyond addressing manufacturing defects.
  • Delivery estimates are not guaranteed; shipping delays may occur due to factors beyond our control.

9Limitation of Liability

  • TaleIt LLC is not liable for indirect, incidental, consequential, or punitive damages.
  • TaleIt LLC's total liability shall not exceed the amount you paid in the twelve (12) months preceding a claim.
  • You acknowledge that reliance on third-party AI providers may result in outages, errors, or service limitations for which TaleIt LLC is not liable.
  • We are not liable for delays, losses, or damages caused by shipping carriers, customs authorities, or our print partner.
  • We are not liable for orders shipped to incorrect addresses provided by you.

10Order Communications

  • Transactional Emails: By placing an order, you consent to receive order-related emails including order confirmations, payment receipts, production status updates, shipping notifications, and delivery confirmations.
  • Required Communications: These transactional emails are essential to order fulfillment and cannot be opted out of for active orders.
  • Contact Information: You must provide a valid email address to place an order; we are not responsible for missed communications due to incorrect email addresses or spam filters.

11Termination and Suspension

  • TaleIt LLC may suspend or terminate accounts for violations of these Terms, misuse, non-payment, or other reasons.
  • Users may appeal termination by contacting support@taleit.ai.
  • Upon termination, access to your account and content will end. You may request retrieval of outputs within 30 days, unless termination resulted from misuse or illegal activity. TaleIt LLC provides no guarantee of permanent storage.
  • Pending orders at the time of termination will be fulfilled if already in production; orders not yet in production may be cancelled and refunded at our discretion.

12Disputes and Chargebacks

  • Contact Us First: Please contact our support team before initiating a payment dispute or chargeback; we are committed to resolving issues fairly and promptly.
  • Chargeback Consequences: Fraudulent chargebacks (chargebacks filed for orders that were delivered as described) may result in immediate account suspension and collection action.
  • Dispute Resolution: We will work with you in good faith to resolve legitimate order issues, including replacements or refunds for defective products.
  • Documentation: We maintain detailed records of orders, shipping confirmations, and delivery tracking for dispute resolution purposes.

13Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-laws principles.
  • Disputes will be resolved by binding arbitration in Utah, under the AAA Consumer Arbitration Rules. Class actions and jury trials are waived.
  • If arbitration is unavailable or unenforceable in your jurisdiction, disputes will be resolved in state or federal courts in Utah County, Utah.
  • If you are a consumer residing outside the U.S., you may have additional rights to bring disputes in your local jurisdiction as required by law.

14Force Majeure

TaleIt LLC is not liable for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, wars, pandemics, strikes, government actions, customs delays, shipping carrier disruptions, or outages/limitations of third-party providers (AI model providers, print partners, hosting, or payment processors).

15Miscellaneous

  • TaleIt LLC may update these Terms at any time. Updates will be communicated via email or in-app notice, and continued use constitutes acceptance.
  • If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • These Terms are the entire agreement between you and TaleIt LLC.
  • Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
